Disobey Stop Sign (HTA s. 136(1)(a)) and Disobey Sign (HTA s. 182(2)
These two charges sound like the same thing and are treated as the same thing by most people who receive them. They are not. They sit in different sections of the Act, carry different demerit points, and require the prosecution to prove different things.
If your ticket says one and your conduct fits the other, that is a live issue.
The two charges side by side
Comparison Point | Disobey Sign | Consequence |
|---|---|---|
Section | s. 182(2) | s. 136(1)(a) |
Demerit points | 2 | 3 |
What it covers | Any posted sign that is not a stop sign or traffic signal | Failing to come to a complete stop at a stop sign |
Record | 3 years from conviction | 3 years from conviction |
Section 182(2) is the general provision. It captures “No Left Turn, “No U-Turn,” Do Not Enter, “No Trucks, “turn-lane restrictions, weight and height restrictions, and the long tail of regulatory signage that does not have its own dedicated section.
Why shouldn’t I pay it?
Eighty-five dollars is cheap enough that most drivers pay it the day it arrives. You are not buying your way out of an $85 problem — you are accepting a three-point conviction that stays on your record for three years and is fully visible to your insurer at every renewal in that window.
Fighting it
A rolling-stop allegation rests entirely on what the officer saw from where they were standing or parked. Vantage point, angle, distance, obstructions, and how the observation was recorded at the time all matter. There is also the question of whether the correct section was cited — s. 136(1)(a) is specific to stop signs, while other posted signs fall under s. 182(2) with a different point value. A charge laid under the wrong section is a problem for the prosecution, not for you.
