A distracted driving charge under HTA s. 78.1 can involve holding, touching, or using a phone, tablet, or similar device while driving. The rule can also apply when you are stopped at a red light or in traffic. A conviction may lead to a fine, demerit points, and a licence suspension.
What is the charge?
Touching, holding, or using a phone, tablet, or similar device while driving. The offence is not limited to moving traffic — being stopped at a red light or in gridlock still counts, because you remain in care and control of the vehicle. Only a 911 call is exempt.
Same fine ranges, but no demerit points are applied — instead the escalating suspension track applies directly: 30 days, then 90 days, then licence cancellation, which means restarting the graduated licensing process from the beginning.
The suspension is the part people do not expect. Most drivers reading a $615 total on their ticket treat this as an expensive parking ticket; the three-day licence suspension attached to a first offence is a separate consequence that arrives regardless of how inconvenient it is for work. For a novice driver, one conviction here can cost the licence entirely and reset years of graduated licensing progress.
